Following the entry into force of the Act on the Protection of Personal Data, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L No. 119, p. 1), we would like to inform you that new regulations on the protection of personal data will come into force on 25 May 2018. Below, we provide information regarding our processing of personal data and the rights applicable in this regard.

HOW WE OBTAINED YOUR PERSONAL DATA

We obtained it from you when you signed the contract for the provision of nursery services at HAPPY Preschool.

WHAT IS THE PURPOSE AND LEGAL BASIS FOR THE PROCESSING OF YOUR PERSONAL DATA BY HAPPY PRESCHOOL

We process your personal data because it is necessary for the proper performance of the contract entered into with you, including for the following purposes:

  • the delivery of the educational process
  • documentation of the teaching process
  • the organisation of the child’s time at the Preschool
  • the Controller’s fulfilment of its information, archiving and statistical obligations arising from the Education Law and the Act on the Education System.
  • processing enquiries you send to us (e.g. via the contact email address on our website: www.przedszkolehappy.pl);
  • contacting you, including for purposes related to the provision of services.

In addition, we are required by law to process your personal data for tax and accounting purposes. We also process your personal data for the purposes set out below, on the basis of HAPPY Preschool legitimate interest, which is:

  • to provide payment services;
  • to handle your enquiries submitted, in particular, to the staff at our premises, to the owners, and via the contact form on our website: www.przedszkolehappy.pl, where such enquiries are not directly related to the performance of a contract;
  • debt recovery; conducting court, arbitration and mediation proceedings;
  • storing data for archiving purposes and ensuring accountability (demonstrating that we have fulfilled our legal obligations).

In addition, if you give your consent, we process personal data for the following purposes:

  • to organise competitions and promotional campaigns in which you can take part;

IS IT MANDATORY TO PROVIDE PERSONAL DATA?

We require you to provide the following personal data in order to conclude and perform the contract entered into with you, and thereby provide the service:

Parents’ details:

  • full name
  • registered address
  • ID card number and series
  • PESEL number
  • mobile phone number, email address

Child’s details:

  • first name and surname
  • PESEL number
  • date of birth
  • home address
  • registered address

You have the right to refuse to provide this personal data; in that case, unfortunately, we will not be able to enter into a contract with you and, as a result, you will not be able to use the nursery’s services.

Where required by law, we may ask you to provide other necessary data, for example for accounting or tax purposes. Apart from these cases, the provision of personal data is voluntary.

RIGHTS IN RELATION TO HAPPY NURSERY REGARDING THE PROCESSING OF PERSONAL DATA:

We guarantee that all rights arising from the General Data Protection Regulation will be upheld, namely the right of access to data, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right not to be subject to automated decision-making, including profiling, and the right to object to the processing of personal data. You may exercise these rights when:

  • you notice that the data provided is incorrect or incomplete;
  • your data is no longer necessary for the purposes for which it was collected by the ‘DZIECIĘCY RAJ II’ Private Nursery; you withdraw your consent to the processing of your data; you object to the processing of your data; your data is being processed unlawfully; your data must be erased to comply with a legal obligation;
  • if you notice that your data is incorrect – you may request that its processing be restricted for a period allowing us to verify the accuracy of that data;
  • the processing of your data is based on your consent or a contract concluded with you, and where such processing is carried out by automated means.

You have the right to lodge a complaint regarding our processing of your personal data with the supervisory authority, which is the Inspector General for Personal Data Protection (address: Inspector General for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).

IN WHAT CIRCUMSTANCES CAN YOU OBJECT TO THE PROCESSING OF YOUR DATA?

You have the right to object to the processing of your personal data where:

  • the processing of your personal data is carried out on the basis of a legitimate interest or for statistical purposes, and your objection is justified by the specific situation you find yourself in,
  • your personal data is processed for the purposes of direct marketing, including profiling for that purpose.

Please note that you may exercise your right to object from 25 May 2018.

ENTITIES TO WHICH WE DISCLOSE YOUR PERSONAL DATA

WE DISCLOSE the personal data we have collected to other entities only in justified cases, in accordance with and within the limits of the law. Examples of such organisations include the Ministry of National Education, the Regional Board of Education, the Shared Services Centre in Marki, Marki Town Hall, the Social Welfare Centre, the Skłodowscy tax consultancy, and the Edukompetencje office.

In certain situations, we are entitled to pass on your data – where this is necessary for the Controller to provide services, in which case the data will be passed on exclusively to persons and entities authorised by the Controller and to whom the Controller has outsourced data processing activities, or where this arises from the Controller’s statutory obligation

We may also disclose your personal data to public authorities responsible for combating fraud and abuse.

Disclosing data to other entities requires separate consent.

 

HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

We retain your personal data for the duration of the contract entered into with you, and also after its termination, for the following purposes:

  • to pursue claims arising from the performance of the contract,
  • to fulfil legal obligations, including, in particular, tax and accounting obligations,
  • to prevent abuse and fraud,
  • for statistical and archiving purposes,

We retain your personal data for marketing purposes for the duration of the contract or until you object to such processing, whichever occurs first.

For the purposes of accountability, i.e. to demonstrate compliance with the regulations governing the processing of personal data, we will retain personal data for the period during which HAPPY Nursery is obliged to retain the data or the documents containing it, in order to document compliance with legal requirements and to enable public authorities to verify such compliance.
